14th Amendment Section 3, is so hot right now. Everyone is talking about it, it’s in the news and making headlines. It is powerful enough to change history by deciding who our next President is. But how well do we really know the 14th Amendment other than if you lead an insurrection against the United States you don’t get to be President?
I figured I’d breaking it down into today’s speak to gain a better understanding. And after reading I must ask the question, does the 14th Amendment Section 3 apply to Donald Trump? What do you think?
14th Amendment
Section 1:
Everyone born or naturalized in the United States and a person subject to United States law are citizens of the United States and whatever state they reside in. States cannot make or enforce laws that limit citizens fundamental rights. No state can deprive anyone of life, liberty or property without due process of law or deny anyone within it’s jurisdiction equal protection of the law.
Section 2:
Representatives will be apportioned amount the states according to their population, excluding Native Americans not taxed. All males 21 or older have a right to vote except in cases of rebellion or crime. Any state that violates this will receive a reduction in their representation in the House of Representatives. Number of male citizens 21 years and older shall be counted in the whole number. (This took away African Americans being counted as only 3/5 of a person.)
Section 3:
If a person has taken an oath to support the Constitution and then takes part in a rebellion against the United States or gives aid and comfort to the enemies of the United States, then they cannot be a:
Senator
Representative
Elector
Officer of the United States
United States Military Officer
Member of a States Legislature
Govenor or
Judge in any State
Congress can change this with a 2/3 vote
Section 4:
Any money the United States owe for paying pension or pays in stopping a revolt wont’ be questioned. The United States or any state cannot pay any money to help in funding a rebellion against the United States and no State or the United States will pay for a freed slave or a lost slave. All bills, obligations and claims are not legal.
Section 5:
Congress can enforce this Amendment by law.
